These terms and conditions govern every sale of goods by Mosh Instruments (“we”, “us”) to the buyer (“you”). When you place an order or accept a quotation, you accept these terms.
1. Quotations and orders
Each quotation is valid for 30 days from the date we issue it. However, a quotation is not an offer you can accept until we confirm your order in writing. We quote prices in US dollars unless we state otherwise. Our prices do not include duties or local taxes.
The minimum order quantity is 1 kg by weight, or 10–20 pieces depending on the item.
2. Specification and samples
We manufacture each instrument to the pattern and specification on your order confirmation. If you supply a drawing, sample or branding artwork, you confirm that you have the right to use it. You also confirm that it does not infringe anyone else’s rights.
Our catalogue photographs are for illustration only. Dimensions follow normal manufacturing tolerances. Therefore, if a tolerance is critical, you must state it on the order.
3. Lead time and delivery
Our usual lead time is 5–7 working days for stock items. For made-to-order and OEM production, it is 1–2 weeks. The lead time starts when we receive cleared payment or an approved sample, whichever comes later.
We deliver on FOB Sialkot terms. Risk passes to you in line with that term. We give delivery dates in good faith as estimates, so they are not of the essence.
We ship worldwide by express courier, air freight and sea freight, subject to export controls. You are responsible for customs clearance in your country. You also pay any import duties, taxes and customs charges.
4. Payment
We require 100% payment in advance, before we start production or dispatch your order. We accept bank transfer, Western Union and card payment. The payer covers all bank charges.
5. Inspection, warranty and returns
We inspect every instrument before dispatch. Our Returns & Refunds policy sets out your rights if goods arrive defective, damaged or incorrect. That policy also forms part of these terms.
6. Regulatory responsibility
We supply our instruments as reusable surgical instruments for use by qualified clinical professionals. We supply them non-sterile. Therefore, you must clean and sterilise them using your institution’s validated protocol before first use and before every later use.
If you import, distribute or resell our instruments, you are responsible for meeting the rules in your market. This includes registration, labelling, language requirements, vigilance reporting and any required conformity assessment. In return, we will supply the technical information you reasonably need to support this.
7. Limitation of liability
Our total liability for any order cannot exceed the invoice value of the goods concerned. We are not liable for indirect or consequential loss. For example, this includes loss of profit, theatre time or contracts. However, nothing in these terms limits our liability where the law does not allow it. This includes liability for death or personal injury that results from our negligence, and liability for fraud.
8. Intellectual property
The pattern names in our catalogue describe instrument geometry. They do not suggest any link with an originating manufacturer. The product photography and text on this site remain our property. As a result, you may not reproduce them without our written permission.
9. Export control
You must not re-export our goods in breach of any applicable export control or sanctions regime.
10. Governing law
The laws of Pakistan govern these terms and conditions. The courts of Pakistan have exclusive jurisdiction.
